This process is governed by the Foreign Exchange Management Act (FEMA) and the Income Tax Act. While funds in NRE and FCNR accounts are generally fully repatriable without limits, repatriating funds from an NRO account—which holds India-sourced income like rent, dividends, and sale proceeds—involves specific tax clearances and documentation. The Forms 145 and 146 are the current regulatory mechanisms (effective from April 1, 2026, replacing the erstwhile Forms 15CA and 15CB) designed to ensure that all applicable taxes on the remitted amount have been paid before the funds leave the country.
The ease and limits of repatriation depend entirely on the type of account holding the funds:
NRE (Non-Resident External) Account: Holds foreign income remitted to India. Both principal and interest are fully repatriable without any upper limit. Interest earned is also tax-free in India.
NRO (Non-Resident Ordinary) Account: Holds India-sourced income. Repatriation from an NRO account is subject to a cap of USD 1 million per financial year per person. This limit applies to capital income (sale proceeds of property, investments, accumulated savings), while current income (rent, dividends, pension) can be transferred without an upper limit after paying applicable taxes.
FCNR (Foreign Currency Non-Resident) Account: Holds fixed deposits in foreign currency. Similar to NRE accounts, the principal and interest are fully repatriable upon maturity or closure.
