Understanding Trust 12A/80G Registration

12A and 80G are the two most crucial certifications for any non-profit or charitable trust in India. While they sound similar, they serve two completely different purposes: 12A provides tax exemption to the trust itself, while 80G provides tax benefits to the people who donate to the trust.

What is 12A Registration? (Exemption for the Trust)
Section 12A (now governed by Section 12AB after re-registration) grants the trust an income tax exemption. Normally, any entity earning income must pay tax. However, under 12A, the Income Tax Department recognizes the trust as a genuinely charitable institution. This means the trust does not have to pay income tax on its surplus income, provided the funds are reinvested into its charitable objectives (and not distributed as profit to any individual).

  • Benefit: The trust's entire income (donations, grants, interest) is exempt from tax.

What is 80G Registration? (Exemption for the Donor)
Section 80G is a benefit designed for the donors. Under Indian tax law, if an individual or a company donates money to a trust registered under 80G, they can claim a deduction on their own personal or corporate income tax (usually 50% or 100% of the donated amount).

  • Benefit: It makes your trust highly attractive to corporate donors (CSR funding) and individual philanthropists, because they get a tax rebate for giving you money.
